These Terms and Conditions ("Terms") govern access to OVARA's website and software services for hotels. By using our website or entering into a service agreement with OVARA, you agree to these Terms.
Service description
OVARA provides AI-assisted guest SMS messaging, knowledge-based responses, service request routing, staff notifications, and a customer dashboard. Features may evolve over time. We do not guarantee uninterrupted or error-free operation.
Hotel responsibilities
- Provide accurate hotel knowledge and maintain it as policies change.
- Obtain appropriate guest consent and disclosures for SMS messaging.
- Comply with applicable laws, carrier requirements, and industry regulations.
- Review escalations and service requests that require human judgment.
Acceptable use
You may not misuse the service, attempt unauthorized access, send unlawful content, or use OVARA in a manner that harms guests, staff, or third parties. We may suspend access for violations or security risks.
Fees
Paid plans, message allotments, and overage rates are described on our website or in your order form. Fees are billed as agreed; taxes may apply.
Disclaimer
THE SERVICE IS PROVIDED "AS IS" TO THE MAXIMUM EXTENT PERMITTED BY LAW. OVARA DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI responses are assistive and do not replace trained staff for emergencies or safety-critical situations.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVARA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY ARISING FROM THESE TERMS IS LIMITED TO THE AMOUNTS PAID BY YOU TO OVARA IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
